Forensic Psychology. Assessment, preparation of the expert report, ratification in court (oral hearing)

What is forensic psychology? It is the branch of psychology framed within legal psychology that applies the principles and research of this discipline to criminology, victimology and testimony psychology. It is used to advise judges in disputes across different areas of law, including civil, criminal and employment law, among others.

Multidisciplinary teams:

Psychology has much to contribute to the field of Law.

Psychological expert assessments:

These are the main tool of forensic psychology, consisting of technical reports that advise judges in different proceedings.

Judges:

Judges sometimes need these reports to broaden their understanding.

What does a forensic psychologist do?

They prepare assessment reports for both the aggressor and the victim. It is incompatible for the same expert to prepare reports for both parties simultaneously in the same proceedings.

FORENSIC PSYCHOLOGIST IN MÁLAGA

Collaboration with Conlavenia

I work in collaboration with a prestigious law firm called Conlavenia in the centre of Málaga. We handle cases in a multidisciplinary way, where each professional contributes their perspective from their own field in order to ensure the best individualised approach and achieve greater success in our clients’ legal proceedings.

In these matters, it is very important that psychology professionals are also involved, to advise, recommend, assess, and prepare forensic and expert reports for trial.

In many decisions related to judgments, judges need these reports to obtain the in-depth and accurate perspective that I provide as a psychology professional.

IN YOUR CASE, A GOOD FORENSIC REPORT CAN MAKE THE DIFFERENCE.

A good expert assessment can be crucial in a trial.

I have solid experience as a forensic expert, working both in courts and privately.

An expert report may be requested by the judge, in which case the court appoints the psychology professional. In other cases, the client themselves decides to provide expert evidence, choosing the expert to carry out the assessment study. In both cases — court-appointed or party-appointed — three principles prevail: neutrality, impartiality and objectivity.

This means that the results of the entire study would be 95 percent the same if carried out by different experts simultaneously; this refers to reliability and validity

ANSWER YOUR QUESTIONS

Frequently Asked Questions

There may be many misunderstandings in relation to this field. If you have any questions, you can write to me.

In assessment processes for psychological expert reports, the assessment generally consists of a semi-structured interview, the use of standardised tests and direct observation. A family member or someone from the person’s close environment is also usually taken into account.

These assessments are carried out over several days, several hours at a time, never all on the same day.

A clinical report provides clinical information in a therapeutic context to the patient or another professional about the diagnosis, symptoms, treatment and progress of a case. It is generally shorter and more concise than a forensic report.

A forensic report aims to provide relevant information on specific issues that are important in legal proceedings. The report is prepared because there is a clear and specific request — the expert purpose or reason for the assessment — to provide professional and scientific information as an expert to a judge.

The forensic psychologist, acting as an expert, contributes their knowledge to legal and judicial matters.

They prepare the expert report and subsequently attend court to ratify it at the oral hearing. Usually, the lawyers for both parties or the judge may ask various questions that the psychologist will have to defend.
